Defamation Law in Johor Bahru
In the age of social media, online reviews and instant messaging, defamation has become one of the fastest-growing areas of legal dispute in Malaysia. A single false post on Facebook, a negative review on Google, or a defamatory message shared in a WhatsApp group can cause serious and lasting damage to your personal reputation or business goodwill. At Messrs S K Song, our defamation lawyers in Johor Bahru help individuals and businesses protect their reputations through both preventive advice and aggressive legal action when necessary.
Defamation law in Malaysia is governed by the Defamation Act 1957 and supplemented by a substantial body of common law developed through court decisions. Our defamation practice is led by Mr. Muhammad Valantino, who advises on both traditional defamation and the increasingly prevalent area of online and social media defamation. Read our defamation and cyberbullying guide for a detailed overview of the law.
Libel and Slander
Defamation takes two forms under Malaysian law. Libel refers to defamatory statements made in a permanent form — written words, published articles, social media posts, photographs or broadcasts. Slander refers to defamatory statements made in a transient form — spoken words or gestures. Both libel and slander are actionable, but libel is generally easier to prove because the defamatory material is preserved in a tangible form. In Johor Bahru, where social media usage is high and online business reviews carry significant commercial weight, libel claims arising from digital publications are increasingly common in our practice.
Social Media Defamation
Social media platforms including Facebook, Instagram, TikTok, X (formerly Twitter) and WhatsApp have become common channels for defamatory publications in JB. A false accusation, a malicious review or a doctored image shared online can reach thousands of people within hours, causing irreparable harm to your reputation, business or professional standing. Our defamation lawyers act swiftly to address social media defamation, including sending cease-and-desist letters, demanding removal of the defamatory content, issuing letters of demand for compensation and, where necessary, filing court proceedings.
We also advise on the interaction between defamation law and the Communications and Multimedia Act 1998, which creates criminal offences for the improper use of network facilities or services, and the Penal Code provisions relating to criminal defamation under Sections 499 to 502. In appropriate cases, we coordinate with the police and the Malaysian Communications and Multimedia Commission to pursue criminal remedies alongside civil claims. See our social media defamation case study for an example of our approach.
Defences to Defamation
Not every negative statement amounts to actionable defamation. The Defamation Act 1957 and the common law recognise several defences. Justification (truth) is a complete defence — if the statement is substantially true, the claim will fail regardless of the damage caused. Fair comment protects honest expressions of opinion on matters of public interest, provided the comment is based on true facts and is made without malice. Qualified privilege protects statements made in certain contexts, such as in the course of legal proceedings, parliamentary debates or employment references, where the maker has a duty to communicate and the recipient has a corresponding interest in receiving the information. Absolute privilege applies to statements made in Parliament, in court proceedings and in certain government communications.
Understanding these defences is important whether you are bringing a defamation claim or defending one. Our lawyers assess the strength of your case with a clear-eyed evaluation of the available defences, ensuring you have realistic expectations before committing to litigation. Remedies for Defamation
If a defamation claim succeeds, the court may award damages to compensate for the injury to reputation, aggravated damages where the defendant's conduct was particularly malicious, and in some cases exemplary damages to punish the wrongdoer. The court may also grant an injunction to restrain further publication of the defamatory material. The assessment of damages depends on the seriousness of the allegation, the extent of publication, the conduct of the defendant and the impact on the claimant's reputation and feelings.
For businesses, defamation can result in lost revenue, damaged customer relationships and diminished brand value. Our lawyers work to quantify these losses and present compelling evidence of the commercial impact of defamation to support claims for substantial damages. We also pursue interim injunctions in urgent cases to prevent ongoing damage pending the full trial.
Cease-and-Desist Letters and Pre-Action Strategy
In many defamation cases, the most effective and cost-efficient outcome is achieved without going to court. Our defamation lawyers regularly draft and send cease-and-desist letters demanding that the defamatory material be removed, an apology published and an undertaking given against future publications. In many cases, a strongly worded letter from a law firm is sufficient to compel compliance, particularly where the publisher is an individual who may not have the resources or inclination to defend a lawsuit. We advise on the appropriate pre-action strategy for each case, balancing the urgency of the situation against the costs and risks of litigation.
